Fair Trading Act 1999
IMPORTANT PUBLIC NOTICE
BY ORDER OF THE MAGISTRATES’ COURT OF VICTORIA
In legal proceedings taken by Consumer Affairs Victoria, based on consumer complaints, the Magistrates’ Court of Victoria at Melbourne has found that Go Get Around Tours Pty Ltd ACN 070 161 750 and its sole director Peter Maloney, both of Stokes Street, Port Melbourne, have breached sections 9, 12(k) and 19 of the Fair Trading Act 1999, in trade or commerce, by:
(i) engaged in conduct that is misleading or deceptive or likely to mislead or deceive in contravention of section 9 of the Fair Trading Act 1999 (“the Act”);
(ii) made false or misleading representations concerning the existence, exclusion or effect of any condition, warranty guarantee, right or remedy contrary to section 12(k) of the Act; and
(iii) accepting payment from consumers for the supply of goods and services and the Respondents did not:
(a) supply the goods and services within the agreed time or any reasonable time, or not at all; or
(b) supplied goods and services that were materially different from the services to which the agreement to supply related –
in contravention of sub-section 19(1) of the Act.

The Court made orders requiring Go Get Around Tours Pty Ltd and its sole director, Peter Maloney:
• restraining them from representing, in any manner, to customers, potential customers and other members of the public who purchased or who may purchase or otherwise acquire goods and services from them that persons have no right to seek to recover a refund of the whole or any part of the price paid by such persons for the goods or services;
• to refund the payments, totalling $860 plus interest, they received from consumers for the supply of goods and services but did not supply; and
• to publish this notice.
This notice is published and paid for by Go Get Around Tours Pty Ltd and Peter Maloney, by order of the Magistrates’ Court of Victoria at Melbourne, dated 28 May 2010.
